1. DMCA Policy
CapitolExposed respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We respond promptly to notices of alleged copyright infringement that comply with applicable law and our procedures outlined below.
2. Designated Agent

3. Filing a Takedown Notice
To be effective, a DMCA takedown notice must comply with 17 U.S.C. § 512(c)(3) and include the following:
- 1A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- 2Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
- 3Identification of the material that is claimed to be infringing, including the specific URL(s) where the material is located.
- 4Your contact information, including your name, address, telephone number, and email address.
- 5A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- 6A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
4. Counter-Notification
If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:
- 1Your physical or electronic signature.
- 2Identification of the material that has been removed or to which access has been disabled, and the URL where the material appeared before removal.
- 3A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- 4Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located.
Upon receipt of a valid counter-notification, we will forward it to the original complainant and restore the material within 10 to 14 business days unless the complainant files a court action seeking to restrain the alleged infringement.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, CapitolExposed has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
6. Public Records Note
Important Context
The vast majority of content on CapitolExposed consists of factual data derived from public government records. This content is generally not subject to DMCA takedown requests.
Works produced by the United States government are not copyrightable under 17 U.S.C. § 105. This includes STOCK Act financial disclosures, FEC campaign finance records, Senate lobbying disclosure filings, congressional vote records, and other official government documents that form the foundation of our platform.
Additionally, factual data and compilations of facts are not copyrightable under the Supreme Court's ruling in Feist Publications, Inc. v. Rural Telephone Service Co., 499 U.S. 340 (1991). The DMCA does not provide a mechanism for removing factual information derived from public records.
